These terms are between you and VARION TEAM LTD, a company registered in England and Wales under number 17230615, whose registered office is at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ. In these terms “we” and “us” mean that company, and “Kcal” means the app of that name.

Using Kcal means accepting these terms. If you do not accept them, do not use it.

An estimate, not a measurement.

Kcal reads a meal from a photograph, a label or a description and estimates what it contained. An estimate is what it is: a model looking at a picture cannot know what is under the sauce, how much oil went into the pan, or how heavy the portion was. Treat the numbers as a guide to a trend, not as a measurement of a plate.

Kcal is not a medical device and gives no medical or dietary advice. It does not diagnose anything and it does not treat anything. If you have a condition affected by what you eat — diabetes, an eating disorder, kidney disease, an allergy, a pregnancy — decide with a professional who knows your case, not with this app.

The daily targets it calculates come from a standard equation applied to the answers you gave. They are a starting point. The app deliberately refuses to recommend very low intakes, but it cannot know whether a target is right for you.

Free to keep a diary. Paid to have it read for you.

Keeping the diary is free and stays free: typing a meal, scanning a barcode, recording your weight, your history, your targets, and syncing between your devices.

Kcal Pro pays for the readings — a photograph, a spoken meal, a label, or a correction — because those are the part that costs us something to provide. Everyone gets three readings before being asked.

It renews until you stop it.

Kcal Pro is sold as an auto-renewing subscription, monthly or yearly. The price, the period and the renewal are shown on the purchase screen before you buy, in your own currency.

Payment is taken by Apple through your Apple Account, and the subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Apple charges the renewal within 24 hours of the period ending.

Where a free trial is offered, it is offered once per Apple Account. If you do not cancel before the trial ends, it becomes a paid subscription at the price shown. Apple emails you before that happens.

You cancel in your Apple Account settings — Settings → your name → Subscriptions on an iPhone — and the app links you there. Cancelling stops the next renewal; it does not shorten the period you have already paid for, which runs to its end.

Apple takes the money, so Apple gives it back.

We never receive your payment and cannot refund it. Refunds are requested from Apple, at reportaproblem.apple.com, and are decided under Apple’s terms.

If you are a consumer in the United Kingdom or the European Union you normally have fourteen days to change your mind about a purchase made at a distance. Digital content delivered immediately is an exception where you asked for it to start at once and acknowledged losing that right, which is what buying an unlockable feature in an app does. This does not affect any right you have under Apple’s own terms, which are often more generous.

A month each, for up to three friends.

If somebody signs up with your code, you both get a month of Kcal Pro. Your side of that is paid for up to three friends; theirs is not capped. The months are added to whatever you already have.

The month is our own giveaway rather than anything bought through Apple, and it is not exchangeable for money. We may withdraw the offer for new invitations at any time, which does not take back a month already given.

Yours, and you can take it or delete it.

What you record is yours. We store it only to give it back to your other devices, and you may export the whole thing as a file or delete your account, which erases it from our servers.

Meal photographs are never stored by us. What we do with everything else is set out in the privacy policy.

A few things not to do.

Do not use Kcal to break the law, and do not try to work around what you have paid for — extracting credentials, sending requests to our service from anything that is not the app, or automating it at a scale it was not built for. We may end access that does.

The app, its name, its design and everything in it stay ours. What you type into it stays yours.

No warranty that a number is right.

We maintain Kcal and try to make its readings better, but we do not warrant that any particular figure is accurate, that the service is uninterrupted, or that it fits a purpose you have in mind. The app is provided as it is.

Nothing here affects rights you have as a consumer that cannot be excluded by law — including, in the United Kingdom, that digital content must be of satisfactory quality, fit for purpose and as described.

What we are, and are not, answerable for.

We do not exclude or limit liability where it would be unlawful to do so: death or personal injury caused by our negligence, fraud, or anything else that cannot lawfully be limited.

Subject to that, we are not liable for loss of profit, loss of business, loss of data, or any indirect or consequential loss. Our total liability arising out of or in connection with Kcal is limited to the greater of what you paid us in the twelve months before the claim and £100.

Leave whenever you like.

Delete the app and, if you have one, cancel the subscription in your Apple Account. Deleting your account in Settings removes what we hold.

We may withdraw Kcal or stop supporting a version, and we may end your access if you break these terms. If we withdraw a subscription service you have paid for, we will refund the unused part of the period through Apple.

An updated version appears on this page. Where a change is material we will tell you in the app before it takes effect, and changes never apply retrospectively to something already done under an earlier version.

England and Wales.

These terms, and any dispute about them or about Kcal, are governed by the law of England and Wales, and its courts have exclusive jurisdiction.

If you are a consumer resident elsewhere in the United Kingdom you keep the right to bring proceedings where you live. If you are a consumer resident in the European Union, nothing here deprives you of the protection of the mandatory law of your own country, and you may bring proceedings there.
